EB-3 Professionals/Skilled Workers
EB-3 skilled worker green cards are designed for individuals who have at least two years of training or work experience in a skilled position. To qualify, the employer must first complete the PERM labor certification process, which shows the U.S. Department of Labor that there are no qualified U.S. workers available for the job and that hiring a foreign worker won’t negatively affect local wages or working conditions.
If there are no qualified applicants to the position, the employer can move forward by filing a petition for an immigrant worker. There are timing considerations involved because the process to obtain a labor certification can take a significant amount of time. Our firm helps strategize how to maintain the employee’s existing nonimmigrant visa or other status while they await a decision on the labor certification.
Once PERM is approved, the employer can file the immigrant petition, and the worker can move forward with obtaining permanent residency. It can take two years or more to finalize a labor certification case, and every detail matters. Our firm is experienced in handling labor certifications and the extensive preparation that must be done before the prevailing wage is even filed. We also help our employers by providing a robust audit file to defend against audits by the Department of Labor, and provide strategic counsel throughout the entire process.
For many applicants, the EB-3 pathway offers a reliable and structured route to a green card through long-term, full-time employment. This is a lengthy process and the timing is critical. Please reach out to our offices today to find out how we can help.
